Definitions<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Consumer:<\/strong>&nbsp;a natural person acting for purposes outside their trade, business, or profession.<\/li>\n\n\n\n<li><strong>Services:<\/strong>&nbsp;bespoke creative services (e.g., branding, visual identity, web\/landing design, motion, consulting).<\/li>\n\n\n\n<li><strong>Digital Products:<\/strong>&nbsp;ready-made digital items (e.g., template packs, design packs, downloadable files).<\/li>\n\n\n\n<li><strong>Deliverables:<\/strong>&nbsp;outputs delivered under Services (final files as specified).<\/li>\n\n\n\n<li><strong>Working\/Source files:<\/strong>&nbsp;editable project files (e.g., AI\/PSD\/AE) unless included explicitly.<\/li>\n\n\n\n<li><strong>Order:<\/strong>&nbsp;your purchase via checkout or written acceptance of our offer\/quote.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>3. Scope of supply<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">3.1. The scope, price, timeline, and included items are defined in the offer\/quote, product description, invoice, or order confirmation.<br>3.2. Anything not explicitly included is out of scope and may require an additional fee.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>4. Order process and acceptance<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">4.1. An Order is binding when we confirm it in writing (email is sufficient) and\/or when we receive the first payment (deposit), depending on the arrangement.<br>4.2. We may refuse an Order if requested content is unlawful or infringes third-party rights.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Prices and payments (50\/50)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">5.1. Prices are listed in&nbsp;<strong>EUR<\/strong>&nbsp;and may include\/exclude VAT depending on applicable rules (as stated at checkout\/invoice).<br>5.2.&nbsp;<strong>Services:<\/strong>&nbsp;payment is split&nbsp;<strong>50% deposit<\/strong>&nbsp;to start work and&nbsp;<strong>50% upon completion, before final delivery\/handover<\/strong>.<br>5.3.&nbsp;<strong>Digital Products:<\/strong>&nbsp;payment is due in full at checkout.<br>5.4. Work may be paused if payments are overdue.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6. Delivery and timelines<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">6.1.&nbsp;<strong>Services:<\/strong>&nbsp;timelines depend on your timely delivery of materials and feedback. Delays from the Client extend timelines accordingly.<br>6.2.&nbsp;<strong>Digital Products:<\/strong>&nbsp;delivery is typically immediate via download link or email, unless stated otherwise.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>7. Revisions (Services only)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">7.1. Unless specified otherwise in the offer\/quote, Services include&nbsp;<strong>two (2) revision rounds<\/strong>&nbsp;per agreed stage.<br>7.2. A revision round means one consolidated list of changes submitted at once.<br>7.3. Additional revision rounds or out-of-scope changes may be billed at an hourly rate or fixed add-on fee (as communicated before work continues).<br>7.4. Once you approve a concept or stage, changes that revisit approved decisions may be treated as additional work.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>8. Client responsibilities<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">8.1. You agree to provide accurate information, materials, and timely feedback.<br>8.2. You confirm that you own or have permission to use all materials you provide (e.g., text, photos, logos, trademarks).<br>8.3. You are responsible for reviewing and approving final content (names, dates, addresses, legal text). We are not liable for errors you approved.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>9. Intellectual property &amp; licenses<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.1 Services (custom work)<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Until full payment is received, all concepts, drafts, and Deliverables remain our property.<\/li>\n\n\n\n<li>After full payment, you receive the rights set out in the offer\/quote.&nbsp;<strong>If not specified, the default is:<\/strong>\n<ul class=\"wp-block-list\">\n<li>a&nbsp;<strong>worldwide, non-exclusive, perpetual commercial-use license<\/strong>&nbsp;for the final Deliverables, for your own brand\/business use;<\/li>\n\n\n\n<li>Working\/Source files are&nbsp;<strong>not included<\/strong>&nbsp;unless explicitly stated.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.2 Digital Products (templates, packs)<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Digital Products are licensed, not sold. Unless the product description states otherwise, you receive a&nbsp;<strong>non-exclusive, worldwide, perpetual Commercial License<\/strong>&nbsp;to use the Digital Product for commercial projects, including client work, subject to the restrictions below.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>License restrictions (always):<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You may&nbsp;<strong>not<\/strong>&nbsp;resell, redistribute, share, sublicense, or publish the Digital Product (or close derivatives) as a competing template, pack, or downloadable product.<\/li>\n\n\n\n<li>You may&nbsp;<strong>not<\/strong>&nbsp;claim authorship or register the Digital Product as your own intellectual property.<\/li>\n\n\n\n<li>You may modify the Digital Product for your own use; restrictions still apply to redistribution.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9.3 Third-party assets<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fonts, stock images, plugins, and other third-party assets may require separate licenses. Unless explicitly stated otherwise, you are responsible for obtaining such licenses.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>10. Portfolio and confidentiality<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">10.1. Unless you request confidentiality in writing before the project starts, we may showcase completed work in our portfolio, social media, and case studies.<br>10.2. For confidential projects, we will not publish identifiable details, except where required by law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>11. Consumer right of withdrawal (EU\/EEA\/UK)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">11.1. If you are a consumer, you may have a statutory right to withdraw from a distance contract within the applicable period in your country of residence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.2.&nbsp;<strong>Digital Products:<\/strong>&nbsp;If you request\/accept immediate delivery of digital content, you acknowledge that you may lose your right of withdrawal once the download\/delivery begins, as permitted by consumer law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">11.3.&nbsp;<strong>Services:<\/strong>&nbsp;If you request that we start the Service before the withdrawal period ends, you acknowledge that:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>you may be required to pay for work performed up to the withdrawal date (pro rata), and<\/li>\n\n\n\n<li>the right of withdrawal may be lost once the Service is fully performed, where allowed by law.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>12. Cancellation (Services)<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">12.1. You may cancel at any time by written notice.<br>12.2. Once work has started, the&nbsp;<strong>50% deposit is non-refundable<\/strong>, except where mandatory consumer law provides otherwise.<br>12.3. If cancellation occurs after work has progressed beyond the deposit value, we may invoice proportionally for work completed up to the cancellation date; we will provide a summary upon request.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>13. Defects, complaints, and remedies<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">13.1. If Deliverables are not in conformity with the agreed scope, notify us within&nbsp;<strong>14 days<\/strong>&nbsp;of delivery, describing the issue.<br>13.2. We will remedy defects within a reasonable time by correction, replacement, or a proportionate price reduction where appropriate.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>14. Liability<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">14.1. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (e.g., for fraud or intentional misconduct).<br>14.2. We are not liable for issues caused by third-party platforms (hosting, social media, printers), or your misuse of Deliverables.<br>14.3. To the maximum extent permitted by law, our total liability is limited to the fees you paid for the relevant Order.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>15. Force majeure<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We are not liable for delays or failure caused by events beyond our reasonable control (e.g., outages, illness, natural disasters, war, governmental actions).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>16. Data protection<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">We process personal data in accordance with applicable data protection laws (including GDPR where applicable). For details, please review our&nbsp;<strong>Privacy Policy<\/strong>&nbsp;available on our website.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>17. Governing law and disputes<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">These Terms are governed by the laws of&nbsp;<strong>Poland<\/strong>, without prejudice to mandatory consumer protection laws in your country of residence. We encourage good-faith negotiation before formal proceedings.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>18. Final provisions<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">If any clause is invalid, the remaining clauses remain effective.
